Terms of Use

1. Contract Formation Conditions

By signing this agreement, the User acknowledges receipt of the vehicle in suitable condition for the contracted service, along with all equipment and accompanying documentation. The driver who signs the agreement guarantees authority and responsibility toward the Lessor for fulfilling the obligations under this agreement.

The User confirms that they meet the minimum age requirements for a driving license and possess the required documentation to operate the vehicle in accordance with the laws of the Republic of Albania. Originals of documents must be provided to the Lessor for verification; copies remain in the possession of AUTO HAFUZI as an annex to this contract.

The User is responsible for any traffic violations committed during the rental period, even after its conclusion.

2. User Obligations

By signing this agreement, the User accepts and undertakes to comply with the following obligations:

  1. The vehicle must be returned at the agreed location and time, in the condition it was received, with the same fuel level unless otherwise requested by the Lessor.
  2. Any extension of the rental period or other changes must be requested in writing to the Lessor at least prior to the contract’s expiration; otherwise, the vehicle may be considered lost by the Lessor.
  3. The vehicle must not be overloaded, used for driver training, commercial passenger transport, racing, speed/durability testing, towing other vehicles, or any illegal activity.
  4. The vehicle must only be operated by drivers declared in the contract and only for personal use in accordance with its intended purpose.
  5. The User must use and handle the vehicle properly and in accordance with normal usage conditions.
  6. When leaving the vehicle, the User must close the windows and lock the vehicle, taking the keys and documents along.
  7. The vehicle must not be driven under the influence of alcohol or drugs; the User must comply with all traffic rules.
  8. The User is obliged to perform regular maintenance (oil levels, coolant, tire pressure, etc.).
  9. If vehicle indicators show maintenance is required or the User notices a defect, they must immediately notify the Lessor and make the vehicle available for inspection/repair. Damages due to negligence are the User’s responsibility.
  10. The vehicle must not carry more passengers or cargo than permitted, and no modifications may be made without authorization.
  11. The vehicle must not cross the borders of the Republic of Albania without the Lessor’s consent; additional fees may apply according to the price list for any unauthorized crossing.
  12. The User bears all expenses related to vehicle use, including fuel, tolls, bridges, parking fees, tickets, and traffic fines.
  13. The User authorizes the Lessor to automatically charge for any traffic offenses, parking tickets, and other fines incurred during the rental period without prior notice.
  14. For corporate clients: with written notice and the Lessor’s consent, the vehicle may be provided to employees who meet the requirements; the corporate entity remains fully liable.

3. Damages and Loss of Documentation

In the event of damage to the vehicle, equipment, documentation, license plates, or keys, the User is obliged to cover the costs of repair or replacement.

Damage to the engine or mechanical parts resulting from lack of fluids (oil, coolant) or negligent driving is not covered by insurance and is the User’s responsibility. The User shall pay the repair costs plus compensation for lost rental income for the repair period (up to a maximum of 30 days) and any additional costs (transport, towing, etc.).

Any damage resulting from failure to follow the manufacturer’s instructions for use and fuel is not covered by insurance.

4. Theft, Accident, or Malfunction

In the event of an accident, theft, mechanical failure, or similar incident, the User must:

  1. Take measures to prevent further damage to the vehicle until it is recovered by the Lessor;
  2. Record the names and addresses of witnesses and participants;
  3. Call the police and obtain the official incident report (excluding minor technical faults);
  4. Notify the nearest office of the Lessor.

If the User fails to provide a police report, statement, or alcohol test (when required), all costs of damages will be charged to them, including lost rental income for the repair period (up to a maximum of 30 days), regardless of fault or whether additional coverage (CDW/SCDW) was purchased.

5. Costs Reimbursable to the User

The Lessor will reimburse the User for reasonable expenses for fuel, lubricants, regular services, and minor repairs approved in advance by an authorized representative of the Lessor. Reimbursement without prior approval is not permitted.

6. Collection and Processing of Personal Data

The User voluntarily provides personal data. The Lessor processes the data in compliance with applicable regulations on personal data protection. Information on processing and user rights is available in the Personal Data Protection Statement.

7. Other Provisions

The Lessor shall not be liable for damages caused by delays in vehicle delivery or for damages arising from normal use or malfunction of the vehicle during the rental period.

The Lessor has the right to immediately terminate the contract and reclaim the vehicle if the User breaches any provision of this agreement. Termination does not limit other rights of the Lessor under the contract.

Important Notice:

THE COMPANY SHALL NOT BE LIABLE FOR EXTERNAL VEHICLE DAMAGES OR FOR THE TIRES. The speed limit is 120 km/h. Exceeding permitted limits may activate GPS monitoring systems; the warranty may be voided, and the User may be fined according to law.
